datalytyks provides no-code solution development services, including but not limited to:

• Workflow automation using platforms such as Make, Zapier, and n8n
• Data solutions using tools such as BigQuery, PostgreSQL, and business intelligence platforms
• Custom application development using no-code and low-code platforms
• Third-party integrations, including financial technology services such as Stripe and Stripe Financial Connections

Our service offerings may expand over time. Additional services and integrations will be subject to these Terms, and any service-specific terms will be documented in this section or in supplemental agreements.

3. Third-Party Integrations

Our Services may integrate with third-party platforms and APIs to provide enhanced functionality. By using features that rely on third-party integrations, you agree to the applicable terms of those third-party providers in addition to these Terms. Specific integration terms are detailed below.

3.1 Stripe Financial Connections

Certain features of our Services may use Stripe Financial Connections to enable you to link your financial accounts. By using these features, you:

• Agree to Stripe's terms and conditions, including the Stripe Connected Account Agreement and Stripe Consumer Terms, as applicable
• Authorize Stripe and datalytyks to access your financial account information as described in our Privacy Policy
• Acknowledge that the availability and accuracy of your financial data depends on your financial institution and Stripe's services
• Understand that you may disconnect your financial accounts at any time

3.2 No Professional Advice

Nothing in our Services constitutes financial, investment, tax, legal, or other professional advice. Any data displayed through our Services, including financial data, is provided for informational purposes only. You should consult qualified professionals before making decisions based on information obtained through our Services.

3.3 Accuracy of Third-Party Data

While we strive to display accurate data, we do not guarantee the accuracy, completeness, or timeliness of information obtained through third-party integrations, including Stripe Financial Connections. Data is provided by third-party platforms and their upstream sources, and may be subject to delays or discrepancies. You should verify all information independently.

4. User Accounts and Responsibilities

4.1 Account Security

If our Services require account creation, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

• Attempt to gain unauthorized access to our systems, networks, or other users' accounts

5. Intellectual Property

5.1 Our Intellectual Property

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, designs, and software), are owned by datalytyks, LLC and are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for their intended purpose. This license does not include the right to:

• Modify, copy, or distribute our content without written permission
• Use our branding, logos, or trademarks without authorization
• Reverse engineer or decompile any software provided through our Services

5.3 Client Work

Ownership of work product created for clients is governed by the specific agreement between datalytyks and the client. Unless otherwise agreed in writing, datalytyks retains ownership of its proprietary tools, templates, and methodologies.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied
• We do not warrant that our Services will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
• Our total liability for any claims arising from or related to our Services shall not exceed the amount you have paid us in the twelve (12) months preceding the claim

7. Indemnification

You agree to indemnify, defend, and hold harmless datalytyks, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any misuse of data accessed through our Services or their third-party integrations

8. Third-Party Services

Our Services may integrate with or contain links to third-party services, including but not limited to Stripe, Cal.com, and other platforms. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services. A list of our current third-party integrations and their applicable policies can be found in Section 3 above and in our Privacy Policy.

9. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause and with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

Upon termination:

• Your right to use our Services will immediately cease
• We will disconnect any linked third-party accounts associated with your use, including financial accounts
• Data associated with your account will be deleted in accordance with our Privacy Policy

10. Data Location

datalytyks is based in Ohio, United States. All data collected through our Services is processed and stored on US-based platforms and infrastructure. By using our Services, you consent to the processing and storage of your data within the United States. For more information about how we handle your data, please refer to our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be resolved in the state or federal courts located in Ohio.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
